Powers of Attorney
Lasting Powers of Attorney (LPA). You know you need one but.......
You're not sure what it really is, or what it does.
You think that you have plenty of time to sort it out.
You don't have time to think about it now.
You don't see the point in having one now because you're fit and healthy.
These are just some of the beliefs many of our clients have when it comes to planning for the future. Actually, there are many reasons you shouldn't put off getting your affairs in order, sooner rather than later.
What is a Lasting Power of Attorney and why is it important?
It is all about YOU .....
It can be used not only if you lose mental capacity but more often, for physical issues due to illness, accidental fall, hearing loss, sight loss or mobility issues. So you use it when you need it and put aside when you don’t
It gives you a voice and allows you to plan in advance who can make decisions on your behalf
It can give guidance to your attorneys as to what your wishes are so there is no misunderstanding
It gives power to your loved ones rather than someone you have not chosen, ie social services etc. There are no legal rights for Next of Kin .... only an attorney
Saves money in not having to go through the Court of Protection route, which is often costly, time consuming and stressful for your loved ones
Offers peace of mind that your affairs will be attended to like, paying bills such as utility bills and care home fees, claiming benefits, pensions and allowances, operating bank or building society accounts, giving gifts to family members or charities and finally buying or selling property if required
With a Lasting Power of Attorney, your loved ones will find it much easier to manage your financial affairs for you effectively as they will have legal authority to do so
With a Health and Welfare LPA your Attorneys can make decisions regarding your personal welfare, and any medical treatment that you may need
A Health & Welfare LPA allows you to discuss in advance your preferences regarding your care and treatment should you later lose mental capacity
With a Health & Welfare LPA your attorneys can make decisions on things such as your day-to-day activities like your diet, dress, or daily routine. The kind of accommodation best suited for your needs such as whether to stay in your home with support or to move into a residential or other care home. It also covers giving or refusing consent in relation to particular types of health care, including medical treatment decisions. So an LPA gives you a great opportunity to set your wishes out
Once you have this in place you will have:
Peace of mind
Clearly set out wishes
A legal document on which to depend
A voice to be heard
